An Affidavit of Inheritance form is needed in the event that an owner of a motor vehicle or small watercraft dies without a will. As long as the estate is not indebted and the surviving spouse and heirs have amicably agreed among themselves the division of the estate, an Affidavit of Inheritance may be used to assign title to the property.
The Affidavit of Inheritance must include the following documentation:
• Applicant’s Name and Address
• Vehicle or Watercraft Make, Model, VIN, Title, And License
• Applicant’s signature
• Stamp, seal, or signature of notary public
If the deceased left a will that is not probated, a legible copy of the will must accompany the Affidavit of Inheritance. A certified copy of the deceased’s death certificate and the vehicle’s original title must also accompany the Affidavit of Inheritance form. All liens shown on the vehicle records must be also released for the Affidavit of Inheritance to be valid.
