The Gift Affidavit can be used to document the transfer of personal property, money, investments or other items of value to a friend, family member or charity as a gift without any expectation of payment. A Gift Affidavit must be signed by the donor, receiver and notarized by a notary public.
A Gift Affidavit is a document also used in circumstances when a gift or loan is given in business situations. The Gift Affidavit states that the package is not for business gain and is a voluntary offering.
The process of preparing a Gift Affidavit consists of the following sections:
• The name, address, contact information, relationship, employment and title of the giver and receiver of the gift.
• A description of each gift and its value along with the date the gift was given.
• A block where the giver describes why the gift was given and a statement declaring there was no business gain intended by the giver.
• Space for signatures of the gift giver, receiver and a notary public.
A Gift Affidavit must be signed by all parties in the presence of a notary public. All parties must declare the statement is truth by oath and under penalty of perjury.
